Texas public schools will be required to provide in-person instruction for students this fall, but state education officials have delayed releasing final public health guidelines for keeping them safe on campuses during the pandemic.

"We are unable to give final guidance today on on-campus instruction. We are actively monitoring the situation, and we will try to get out final information as quickly as possible," Texas Education Commissioner Mike Morath said during a Tuesday briefing of school superintendents who had been expecting him to outline the agency's reopening guidelines.

A draft document found on the Texas Education Agency's website Tuesday showed agency officials are envisioning a largely hands-off approach to helping school districts bring students back to campus this fall, imposing few mandatory safety precautions but recommending that staff and students wear masks, sanitize their hands regularly and stay 6 feet away from one another.

The light-handed oversight role parallels the state's overall approach to the coronavirus pandemic under Gov. Greg Abbott, with local officials, parents and students expected to devise their own strategies for protecting their health.

"These are draft documents. They were posted in the staging portion of the TEA website by mistake as part of an internal document review," the agency said in a statement. "As we continue to closely monitor the public health situation, we are, in fact, still soliciting feedback on this guidance. No final decisions have yet been made. Additional guidance will be provided soon.”

Local school officials have been waiting on state guidance so they can begin making decisions as they plan for the start of a new school year. "I understand the pause in releasing those guidelines considering what's going on with what seems to be a resurgence, particularly in our large, urban areas," HD Chambers, superintendent of Alief Independent School District, told the Texas Tribune. "At some point, we gotta know because we have to make decisions."

And state Democrats have excoriated Abbott for deciding to reopen schools amid rises in COVID-19 cases. "The decision to reopen comes despite severe concerns from students, teachers, and parents that returning to school may not be safe in the fall," a working group of state House Democrats said in a statement Tuesday. "The announcements also coincide with an outbreak of COVID-19 that has led to nearly two weeks of record hospitalizations and rising cases that even Gov. Abbott decreed 'unacceptable.'"

With cases of the coronavirus surging to record levels in Texas, Gov. Greg Abbott recommended Tuesday that Texans stay home as much as possible and for the first time moved to allow the tightening of two kinds of restrictions that had been eased under his reopening plan.

"We want to make sure that everyone reinforces the best safe practices of wearing a mask, hand sanitization, maintaining safe distance, but importantly, because the spread is so rampant right now, there’s never a reason for you to have to leave your home," Abbott said during an early-afternoon interview with KBTX-TV in Bryan. "Unless you do need to go out, the safest place for you is at your home."

Within hours, Abbott made two announcements to alter the reopening process. He scaled back a previous statewide order and gave local officials the ability to place restrictions on outdoor gatherings of over 100 people, a threshold he originally set at 500 people. And Abbott said the state would enact mandatory health standards for child care centers after prior rules became voluntary earlier this month.

The moves came a day after Abbott said at a news conference that the coronavirus was spreading at an "unacceptable rate" but did not offer any new policies to stem the virus' spread. Instead, he reiterated long-established guidelines such as social distancing and pointed out that the state was increasingly cracking down on businesses that allow large crowds. At the news conference, Abbott also encouraged Texans to stay home, albeit in less explicit terms than he did in the KBTX interview.

The Monday news conference marked a newly urgent tone by Abbott, which he continued on Tuesday. During TV interviews in the noon hour, he made the somewhat unusual move of getting ahead of the state's daily announcement of new coronavirus cases, bracing audiences for a new record high exceeding 5,000 — a big increase over the last peak of 4,430 on Saturday.

Before sharing the new record figure with KBTX, Abbott said he was trying to "make sure people around the state really comprehend the magnitude of the challenge we’re dealing with."

By the end of the afternoon, the state Department of State Health Services had reported the precise number: 5,489 new cases.

At the same time, two metrics that Abbott has prioritized — hospitalization levels and positivity rate — continued to trend in the wrong direction. Hospitalizations reached 4,092, marking the 12th straight day of a new peak. The positivity rate — or the ratio of cases to tests, presented by the state as a seven-day average — reached 9.76%, back to the level it was at in mid-April.

As the number of patients hospitalized with the coronavirus has reached record highs 12 days in a row, Gov. Greg Abbott and other health officials have stressed that the state has an “abundant” capacity to care for them.

Statewide, there were 14,260 available hospital beds and nearly 1,500 intensive care unit beds as of Tuesday.

But regionally, some hospital officials are reporting that intensive care units — for seriously ill patients, like those on ventilators — are near or over capacity, and local leaders have warned that hospitals could get overwhelmed if the number of infections keeps climbing.

In the hard-hit Houston region, hospitals have begun moving coronavirus patients from crowded ICUs to other facilities. A local children’s hospital said this week it is admitting transfer patients, with and without the virus, to help other facilities manage their capacity.

The governor struck a newly urgent tone Monday in a televised press conference to say COVID-19 was “spreading at an unacceptable rate” and that multiple metrics to gauge the virus’ spread and severity had significantly increased. Epidemiologists have attributed upticks in infections and hospitalizations to changes in behavior, including lax mask use and less social distancing.

Abbott spokesperson John Wittman said hospitals in Houston and Austin have been “emphatic” that beds will be available for coronavirus patients. He also said the governor has made clear that “he will utilize tools as necessary to ensure hospitals will provide beds for anyone who tests positive for COVID-19.”

More people are out and about, and coronavirus cases are rising in Texas. But there's an easy way to limit the spread of the virus if people will set their politics aside: masks.

Is wearing a mask a political statement or an intelligence test?

Masks have become signifiers of how seriously people take the pandemic and the advice from government officials and medical experts that wearing a mask in public is a simple and effective way to curb the spread of the coronavirus.

If you want to make a political game of it, go ahead. But be warned: The masks are winning that fight.

Science trumps ideology on this one.

The number of Texans hospitalized for COVID-19 has set records for ten days in a row. The number of deaths attributed to the pandemic in Texas has crossed the 2,000 marks. The number of coronavirus cases to date is closing in on 100,000 and is heading in that direction at an increasing rate of speed.

More people are out and about. Their interactions — whether for work, for shopping, dining, drinking, demonstrating, you name it — give the virus more opportunities to spread. And the numbers show it, whatever your politics. This is getting worse, and the easiest way to slow it down, short of closing everything down again, is for more Texans to do the simple things: distance, handwashing, and masks.

Coronavirus fears postponed a Texas election. Now it will go forward with even greater risk for some voters.

When the coronavirus threat was newer and seemed more immediate, Texas postponed its May elections to pick winners in several party primary runoffs, fearing the health risks of exposing voters and poll workers.

With those statewide elections about to take place, the health risks voters face are now arguably greater than when the runoffs were initially called off.

The virus appears to be in much wider circulation than the original May 26 runoff date, with the state coming off a full week of record highs for COVID-19 hospitalizations and several consecutive days of record highs for daily reported infections.

But voters won't be required to wear masks at polling places. Gov. Greg Abbott, who earlier expressed concerns about exposing Texans "to the risk of death" at crowded polling sites, has forbidden local governments from requiring people to wear them in public.

And Texas Republicans, led by state Attorney General Ken Paxton, have successfully fought off legal efforts by Democrats and some voters to let more people vote by mail if they are fearful of being exposed to the virus at polling places.

With cases of the new coronavirus on the rise statewide and nationally, Gov. Greg Abbott will provide the latest on Texas’ response to the outbreak during a press conference Monday in Austin.

The updates will follow a weekend of record-setting coronavirus figures in the state. On Sunday, Texas reported its 10th consecutive day of record-high hospitalizations as well as the second-highest number of new coronavirus cases to date.

Texas has also increased the number of coronavirus tests administered: The state-reported more than 62,000 viral tests Saturday, the most ever logged in one day.

Texas Department of State Health Services spokesperson Chris Van Deusen said part of the increase in cases is attributable to Texans going to bars, beaches, rivers, and other social gatherings. The state’s latest reopening guidelines allow restaurants to operate at 75% capacity and bars to operate at 50% capacity.

Abbott will address the state’s response starting at 2 p.m. Central time Monday.

Texas companies would feel the impact of a limit on H-1B visas

The Trump administration is planning to severely limit approvals of new H-1B visas. Companies use that type of visa to bring in temporary guest workers to fill specialized roles, and Texas could be the state most affected by the changes.

More H-1B visas were issued in Dallas-Fort Worth than anywhere outside of the New York City area between 2010 and 2016 — more, even, than Silicon Valley — according to a report from the Pew Research Center.

Houston, Austin and Bryan-College Station were also in the nation's top 20.

Drexell Owusu from the Dallas Regional Chamber of Commerce says these work permits are vital for companies that can't find Americans with the right technical expertise. And it's not just internet companies that use them.

"Certain types of engineers or certain types of manufacturing techs," he said. "Lots of highly specialized skill sets."

Even before the coronavirus pandemic, the Trump administration was pushing to limit H-1B workers. A Sugar Land-based company is currently suing over a separate, 2018 policy change to the program. The administration wants companies to hire Americans instead.

Owusu doesn't think that's likely.

"That is a possibility, however, we believe it's a fairly low possibility," he said. "In particular, the regulations for H-1B and other visa categories are so stringent and very restrictive. Employers have to demonstrate that they can't fill that position with anybody else in this country and therefore require us to have a foreign national to fill the role."

Texas apartment markets will slowly rebound

Texas apartment markets have suffered setbacks due to the COVID-19 pandemic.

But the rental business is expected to recover over the next 18 months as the impact of the coronavirus subsidies, according to a new forecast from CBRE.

Researchers with the commercial real estate firm looked at major apartment markets across the state.

So far, Dallas-Fort Worth is the top-performing market, with a lower vacancy rate and the smallest declines in rental rates.

“The Texas multifamily markets have many challenges over the months ahead,” Jeanette Rice, CBRE’s America's head of multifamily research, said in the new report. “The markets may not totally stabilize until the fourth quarter.

“Yet 2021 should experience steady recovery, and Texas’s pre-COVID-19 strengths should play a big role in helping apartment demand return rapidly through 2021,” she said.

CBRE is predicting that Texas apartment markets will be back to pre-pandemic levels by the start of 2022.

While job losses in the state and business closings have spiked with the pandemic, Rice said a rebound in migration and new jobs in Texas will boost the rental market.

“In the short term, with greatly reduced employment opportunities, migration into Texas will slow, hindering the creation of new multifamily demand,” she said. “Longer term, as the economy begins to get back on its feet, the major Texas metros should again attract large numbers of new residents, thereby creating high levels of market demand over the following years.”

While the apartment industry hasn’t suffered near the declines seen in hotels and retail, the economic impact of COVID-19 has caused an increase in vacancy rates and has prompted slight declines in rents in some markets.
